HOW TO ORDER

The Bdk Parfums website allows you to order "Bdk Parfums" brand products online via www.bdkparfums.com.

Hereinafter referred to as "the Bdk Parfums website".

Products are described and presented as accurately as possible, with mention of their essential characteristics within the meaning of article L. 111-1 of the French Consumer Code.

Each time you place an order on the Bdk Parfums website, you will be asked to confirm your acceptance of these General Terms and Conditions of Sale in force on the date your order is placed by ticking the box provided for this purpose.
Failing this, the order cannot be placed.

Please check that your selection is correct before confirming your order. You are informed that the order is subject to payment.

An order confirmation is sent to you by e-mail; this e-mail contains, on the one hand, the acknowledgement of receipt of your order with the description of the Bdk Parfums products selected, the quantity, the price as well as the amount of shipping costs, the associated payment, and on the other hand, the GCS in the version accepted by you, thus constituting proof of the order, and of the contract entered into.

In the absence of proof to the contrary, the data recorded by Bdk Parfums constitutes proof of all transactions between Bdk Parfums and its customers.

The status of the order can be consulted at any time by the customer from your customer account accessible from the Bdk Parfums website, access to which is reserved for you by a password chosen by you. The information and details filled in by the customer can be modified at any time by the customer; the latter can also access information relating to any previous orders.

AVAILABILITY

Our product offers and prices are valid as long as they are visible on the site, while stocks last. In the event of unavailability of a product after you have placed your order, we will inform you by email as soon as possible, offering you either to order another article presented on the Bdk Parfums website as a replacement, or to cancel your order. If you choose to cancel your order, you will be immediately reimbursed if your bank account has been debited.

Orders placed on the Bdk Parfums website are reserved for private individuals and "end-buyer" companies. The resale or distribution of Bdk Parfums products purchased on the Bdk Parfums website is strictly forbidden.

Bdk Parfums is a retailer and does not sell products in large quantities. Consequently, Bdk Parfums reserves the right to limit the quantity of products ordered or to refuse orders for the same product in large quantities, in accordance with the provisions applicable in this matter, and in particular those of Article L122-1 of the French Consumer Code.

Bdk Parfums reserves the right to change at any time and without notice the products offered for sale on the Bdk Parfums website.

AVAILABILITY

The prices of Bdk Parfums products are indicated in euros and include all taxes but do not include shipping and handling costs.


Bdk Parfums reserves the right to modify the prices of products offered on the Bdk Parfums website at any time and without notice. Products are invoiced on the basis of the prices displayed on the Bdk Parfums website at the time your order is placed, subject to availability of the products ordered at that time.


Products remain the property of Bdk Parfums until full payment has been received by Bdk Parfums. On the other hand, you assume the risks (notably of loss, theft or deterioration) concerning the products delivered and this from the effective date of delivery.


Apart from the cases of reimbursement described below, Bdk Parfums will not reimburse the VAT applied to purchases made on the Bdk Parfums website (even in the case where the buyer, after receipt, reships the Bdk Parfums products to a country outside the European Union).

PAYMENT

All orders placed on the Bdk Parfums website must be paid for immediately upon placing your order. We only accept payment by credit card and via PayPal.

All orders are payable in euros. Your order will only be dispatched once we have verified your payment method and received authorization to debit your card.

Your credit card will not be debited until your order has been dispatched. In the event of unavailability of certain items ordered, only the price and shipping costs relating to available products will be debited.

Bdk Parfums uses SSL encryption to protect all data related to personal information and means of payment. In all secure areas where the URL address begins with https:// (where the "s" stands for secure), information is encrypted and therefore protected before being transferred via the Internet.

For certain orders, you may be asked to make an authenticated and secure payment using the 3D Secure system (via "Verified by Visa®" or "MasterCard® SecureCode"). In this case, you will need to enter the personal information requested by your bank in order to finalize your payment.

The following payment methods are accepted: Carte Bleue, Visa Card, American Express Card, Master Card and PayPal.

FRAUD PREVENTION

Bdk Parfums reserves the right to cancel or refuse the order of a customer with whom it is in dispute over a previous order, or if Bdk Parfums reasonably believes that the customer has violated these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.

In the event of loss, theft or any fraudulent use of your password, you agree to immediately notify Bdk Parfums.

DELIVERY

Products purchased on the Bdk Parfums website can be delivered anywhere in the world.

Shipping is free for all orders over 50€.

Before the final confirmation of your order, the amount of shipping costs is clearly indicated.

Products are dispatched to the delivery address you gave when you placed your order.

Orders are delivered via Colissimo according to the following indicative delivery times, plus a maximum of 72 hours for processing your order and forwarding it to the carrier.

Metropolitan France: 2 to 3 working days
European countries: 4 days (indicative minimum in working days).
In the event of a delay of more than 7 days, you have the option of cancelling your order and allowing us additional time to deliver, in accordance with legal provisions. In this case, if you have received the product after your cancellation, we will reimburse you for the product and the cost of returning it, within 14 days of receiving it from us, complete and in its original condition.

Bdk Parfums reserves the right to split deliveries. Your credit or debit card will be debited in the same way to correspond to the price of the products actually delivered. Transport costs will only be invoiced for a single shipment and in accordance with the indications appearing in your order summary.



DELIVERY PROBLEMS

Any defect or delay in delivery exceeding seven (7) days must be reported to our Customer Service Department as soon as possible.

You must check the conformity of the goods at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomalies noted (open package, damaged product, etc.). You must then contact Customer Services within three (3) days of delivery (or ten (10) days of delivery if the carrier has not given the consumer the opportunity to check the condition of the products) by e-mail at customerservices@bdkparfums.com.

CANCELLATION - RETURNS - EXCHANGES - REFUNDS

Once completed, your order is sent to Bdk Parfums for processing.
You can modify or cancel your order by contacting customer service by e-mail at customerservices@bdkparfums.com.
RIGHT OF WITHDRAWAL (RETURNS - EXCHANGES - REFUNDS)
In accordance with the legal provisions in force, you have a period of 14 days from receipt of your products to exercise your right of retraction without having to justify your reasons or pay any penalty. In the case of split deliveries, the withdrawal period runs from the last delivery. A standard withdrawal form is attached below. The customer may use the retraction form below or exercise his right on any other medium provided that said right is exercised in an unequivocal or ambiguous manner.

Withdrawal form in accordance with article R.121-1 new and appendix of the French Consumer Code; please complete and return this form only if you wish to withdraw from your Order placed on the Bdk Parfums website - except for exclusions or limits to the exercise of the right of withdrawal in accordance with the applicable General Terms and Conditions of Sale - and send it directly to customerservices@bdkparfums.com.

If you exercise your right of withdrawal within the above-mentioned period, the price of the product(s) purchased and shipping costs will be reimbursed in full; you will be responsible for return shipping costs. Returns must be in their original condition and complete (packaging, accessories, instructions, etc.) to enable them to be remarketed as new, and must be accompanied by a copy of the purchase invoice for optimum management.

In accordance with the regulations in force, the right of withdrawal cannot be exercised for products unsealed by the customer or products that have been personalized at your request.

You may return any product ordered on the Bdk Parfums website for an exchange or refund in accordance with the conditions provided for the delay of more than 7 days from the indicative delivery date or the right of withdrawal. Returned products will be reimbursed within fourteen (14) calendar days of the date on which we receive the products returned by you.

To request a return, please send the above retraction form to customerservices@bdkparfums.com. Our Customer Service Department will then contact you to advise you of the procedure to follow.

The right of withdrawal does not apply, in accordance with legal provisions, to consumable products that have been opened and/or used, to products whose protective covers or seals have been opened, or to products or product packaging that have been damaged so that they cannot be remarketed.

For legal reasons relating to transport, the return of products containing alcohol is subject to a specific procedure. The following conditions apply to perfume returns:

The product must not be opened and must be returned in its original packaging (shrink-wrapped).
In the event of a return for a defective or damaged product, the customer must ensure that the bottle is still airtight (if not, please contact our Customer Service).

In the event of an exchange (except in the case of a product received as a gift): If the value of the product(s) chosen as a replacement is greater than the value of the product(s) returned, you must pay the price difference in accordance with these General Terms and Conditions of Sale.

If the value of the product(s) chosen as a replacement is less than the value of the product(s) returned, the difference in price will be reimbursed by Bdk Parfums in accordance with the present Terms and Conditions of Sale, except in the case of gift orders.

In the event of an exchange, the shipping costs for the first shipment will be reimbursed, but the shipping costs for the second shipment will be invoiced. Products must be returned under the conditions indicated in the previous paragraph. Bdk Parfums will make the refund within fourteen (14) working days of receipt of the returned products, by crediting your credit card. We do not offer refunds, even partial, if you have received the product as a gift.


LEGAL WARRANTIES - WARRANTY EXCLUSIONS

In accordance with the legal provisions in force, we will reimburse you or exchange defective, non-conforming products that do not correspond to your order.

Products sold on the Bdk Parfums website are subject to the legal warranty conditions stipulated in articles L 211-4, L 211-5 and L 211-12 of the French Consumer Code, as well as articles 1641 and 1648 of the French Civil Code:

Article 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he known of them.

Article 1648 of the French Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be discharged of any apparent defects.

Article L211 -4 of the French Consumer Code: The seller is required to deliver goods in conformity with the contract, and is liable for any defects in conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility.

Article L211 -5 of the French Consumer Code: To conform to the contract, the goods must : Be fit for the use normally expected of similar goods and, where applicable, correspond to: the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; present the qualities that a buyer may legitimately expect having regard to public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling; or present the characteristics defined by mutual agreement between the parties or be fit for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.

Article L211-12 of the French Consumer Code: Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.

INTELLECTUAL PROPERTY RIGHTS
The Bdk Parfums website is protected by copyright. The use of all or part of the Site, in particular by downloading, reproduction, transmission or representation on any medium and by any process, for purposes other than personal and private use for non-commercial purposes is strictly prohibited.

The company names, brands and distinctive signs reproduced on the Bdk Parfums website are also protected under trademark law. The reproduction or representation of all or part of one of the aforementioned signs must be subject to prior written authorization from Bdk Parfums.

In general, any unauthorized reproduction or representation of trademarks, logos, designs, models, literary, musical, audiovisual, photographic works and more generally any element likely to be protected by an intellectual property right accessible on the Bdk Parfums website is prohibited and would constitute an infringement within the meaning of Articles L335-2 et seq. of the French Intellectual Property Code, unless such reproduction or representation is reserved exclusively for strictly personal and private use.

LIMITATION OF LIABILITY

In no event will Bdk Parfums be liable for any indirect, incidental, special or consequential damages, including but not limited to loss of business, loss of profits or loss of opportunity, resulting from the purchase of Bdk Parfums products on the Bdk Parfums website.

Bdk Parfums cannot be held responsible for the obligations of the present Conditions in the event that the non-performance of its obligations is attributable to the act of a third party, even if foreseeable, to the fault of the customer, or to the occurrence of an event of force majeure as defined by the French courts, or to any other event that was not reasonably under the exclusive control of Bdk Parfums.

The products offered comply with current French, European and American legislation and standards applicable in France, Europe and the United States. Bdk Parfums cannot be held responsible in the event of non-compliance with the legislation of the country where the product is delivered (for example in the event of a product ban...).

It is your responsibility to check with local authorities about the possibility of importing or using the products you intend to order.

Photographs are provided for illustrative purposes only. Bdk Parfums cannot be held responsible for any errors or inaccuracies in the photographs or graphic representations of Bdk Parfums products appearing on the Bdk Parfums website.

It may be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders, for their management, execution, processing and payment.

This information and data is also kept for security purposes, to comply with legal and regulatory obligations, and to enable us to improve and personalize the services we offer you and the information we send you.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to any personal data concerning you. All you have to do is write to us online at infos@bdkparfums.com or by post to PARFUMS BDK, 120, Boulevard Maurice Barres, 92200 Neuilly-sur-Seine (for the French and European online stores), giving us your full name and e-mail address.In accordance with current regulations, your request must be signed and accompanied by a photocopy of an identity document bearing your signature, and specify the address to which you would like a reply. A reply will be sent to you within 2 months of receipt. Depending on the choices you make when creating or consulting your account, you may receive offers and information from our company. If you no longer wish to receive such information, you may request that we do so at any time by indicating this in your account.

If the customer's telephone number is collected when creating an account or placing an order, we inform the customer that his or her telephone details will only be used to process orders or to contact him or her to offer new services.

Without prejudice to the foregoing, in accordance with legal provisions, we inform the customer that he or she may, if he or she so wishes, register on the opposition list against telephone canvassing. APPLICABLE LAW

These General Terms and Conditions of Sale are governed by and construed in accordance with French law. These Terms and Conditions are written in French.

PARFUMS BDK will do its utmost to resolve any dispute with the customer amicably, and all disputes will be settled exclusively by the French courts. The customer is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or any other alternative dispute resolution method.
